The federal government is in charge of enforcing the nation’s immigration laws.
But when the federal government fails to do its job and follow Article IV, Section 4 of the Constitution — and guarantee all 50 sovereign states a ‘republican form of government’ — then the federal regime becomes illegitimate and its edicts should be cast aside by governors.
Such is the case in a ruling this week from an activist federal judge put on the bench by Barack Obama.
Florida has a law banning the establishment of “sanctuary cities” — that is, allowing local jurisdictions to forbid the enforcement of federal immigration laws.
It is perfectly within the purview of a state to make such a law.
It’s none of the federal government’s — of the federal judiciary’s — business.
But apparently, the Feds haven’t gotten the memo.
The Epoch Times reports:
A Florida law prohibiting the establishment of so-called sanctuary cities, or municipalities trying to shield illegal immigrants from arrest, violates federal law, a judge ruled this week.
Florida Senate Bill 168 bars sanctuary policies, or policies that prohibit or impede law enforcement from complying with federal immigration law or that block law enforcement agencies from communicating or cooperating with federal immigration agencies.
The Florida legislature passed the legislation in 2019 and Gov. Ron DeSantis, a Republican, signed it into law.
But some of the groups that supported and were involved with crafting the law, including the Federation for American Immigration Reform (FAIR), have 'been described as anti-immigrant hate groups,' U.S. District Judge Beth Bloom, an Obama nominee, wrote in her 110-page ruling.
'This involvement strongly suggests that the Legislature enacted SB 168 to promote and ratify the racist views of these advocacy groups,' she added.
This lunatic activist judge cannot read minds, so her assessment of ‘why’ the law was passed in the first place is complete garbage. Plus, like we said, Florida banning the protection of people in the country illegally is none of the federal judiciary’s business.
Gov. Ron DeSantis shouldn’t even waste state taxpayer dollars appealing this POS ruling. States are free to engage in small ‘r’ republicanism because it’s guaranteed in our Constitution.
He should just ignore this ruling and continue running the state he was elected to run.
