In a case that will no doubt send shivers up the spines of Leftists all over the country, an Alabama judge is allowing a lawsuit to go forward that has been filed against an abortion clinic for aborting his child without his consent.
In the first-of-its-kind suit, Ryan Magers, 19, is claiming that his then-girlfriend got an abortion at the Alabama Womenâ€™s Center for Reproductive Alternatives in Huntsville, Alabama in 2017. According to state law, unborn babies are considered persons with full rights; Magers is suing on behalf of the unborn child dubbed “Baby Doe.”
As reported byÂ Fox News, Madison County Probate Judge Frank Barger granted Magers the right to represent the baby’s estate in two wrongful death suits that have been filed against the clinic.
â€œBaby Roeâ€™s innocent life was taken by the profiteering of the Alabama Womenâ€™s Center and while no court will be able to bring Baby Roe back to life, we will seek the fullest extent of justice on behalf of Baby Roe and Baby Roeâ€™s father,â€ Attorney Brent Helms said in a statement.
â€œThe time is ripe for consistency in Alabamaâ€™s jurisprudence: Either we fully acknowledge the personhood of the unborn or we cherry pick which innocents we protect and which ones we trash for profit,â€ he said.
Helms said he believes that this is the first case of its kind in which a court has recognized a father’s right to sue on behalf of his unborn child.
â€œWe have already had a victory, and it was the first one of its kind, ever,â€ Helms said, as further reported byÂ WAAY.
Magers filed the suit last month. â€œIâ€™m here for the men who actually want to have their baby,â€ he said at the time,Â WAAYÂ reported.
â€œI believe every child from conception is a baby and deserves to live,â€ Magers noted further, adding that he tried to talk the baby’s mother out of the abortion, which she had in her sixth month.
â€œI just tried to plead with her and plead with her and just talk to her about it and see what I could do, but in the end, there was nothing I could do to change her mind,â€ Magers said. â€œEven though thereâ€™s nothing I can do for the situation I was in, there is something I can do for the future situations for other people.”
The suit comes as Americans voice rising support for new laws that would make very late-term abortions illegal. The rise in support for such legislation comes after Democrat-run states have passed bills allowing for late-term abortions and after some Democrats, including Virginia Gov. Ralph Northam, have expressed support for infanticide — aborting a baby after it’s born.
