(National Sentinel)Â Unconstitutional: As promised, incoming House Speaker Nancy Pelosi says the new Democratic majority will introduce legislation expanding background checks for all gun purchases, including those that currently take place between individuals.
“The new Democratic majority will act boldly and decisively to pass commonsense, life-saving background checks that are overwhelmingly supported by the American people,†Pelosi said, Politico reported Monday.
Democratic California Rep. Mike Thompson, an ally of Pelosi, said a bill for universal background checks will be introduced to Congress in early 2019. He is leading the effort, Politico noted.
“The American people want this. They’re way ahead of the Congress, they’re way ahead of the White House,†Thompson said, according to Politico. “I think you will see it happen in the first 100 days [of 2019].â€
Rep. Jerrold Nadler, D-N.Y., who is set to take over the House Judiciary Committee, said, “We told the American voters that we do mean to do this, and we do mean to do it.”
Some polls say as many as 60 percent of Americans favor stricter gun control, and Democrats are only too happy to give it to them.
But the fact is, it doesn’t matter how the issue polls: Gun rights are protected by the Constitution. What’s more, the Second Amendment says that those rights “shall not be infringed;” subjecting someone to a “background check” is akin to forcing them to get federal government permission to exercise their right.
Imagine if some lawmaker introduced a “background check” requirement for anyone wishing to launch their own news site on the pretense of ensuring factual information was published? Or speech on the pretense of protecting against “hateful” words? Or to practice their religion?
Why is the Second Amendment the only one subjected to government permission?
Any gun control laws, when you look at the very plain language of the Second Amendment, could be considered as a violation of the “infringement” clause.
This is certainly true of requiring citizens to get permission from the federal government to exercise their right to keep and bear arms.
